Terms and conditions

These terms govern your access to and use of the AeroTape website (the “Site”) operated by AeroTape, LLC (“AeroTape,” “we,” “us,” or “our”). By using the Site, you agree to these terms and to our privacy policy. If you do not agree, do not use the Site.

The Site is an informational sales site. It is not a storefront, and submitting an inquiry does not create a purchase, supply, or confidentiality agreement. Any sale or other commercial relationship is governed by a separate written agreement.

Site content

Descriptions of products, applications, and capabilities on the Site are general and may change. They are not a quotation, specification, warranty, or offer. Availability, pricing, and technical requirements are confirmed only in a written communication or agreement from AeroTape. We may correct errors and update or remove Site content at any time.

Inquiries and submissions

If you contact us through the Site, you agree that the information you submit is accurate and that you have authority to provide it. Do not submit classified information, export-controlled technical data, or other information you are not authorized to share.

Ideas, suggestions, and other materials you send through the Site, other than the personal and project information described in our privacy policy, are not confidential. Do not send proprietary information you expect us to keep confidential unless we have agreed to do so in writing.

Text messages

If you opt in on this Site, AeroTape may send recurring text messages about your inquiry. You may receive up to 4 messages per month. Message and data rates may apply. Reply STOP to opt out and HELP for help. Consent is not required to submit an inquiry or to purchase anything. We will not share your mobile number with third parties. Message handling is also described in our privacy policy.

Intellectual property

AeroTape and its licensors own the Site and its content, including text, graphics, marks, and the arrangement of the pages. You may view and print pages for your own internal business reference. You may not copy, republish, frame, or create derivative works from the Site for commercial use without our prior written permission.

If you believe material on the Site infringes your copyright, send a notice to the contact address below that identifies the work, the material you believe is infringing and where it appears, your contact information, a statement that you have a good-faith belief the use is not authorized, and a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act for the owner.

Acceptable use

You agree not to:

• Use the Site in violation of applicable law, including export-control laws;
• Interfere with the Site, probe it, or attempt unauthorized access;
• Introduce malware or use automated means to scrape or copy the Site;
• Impersonate AeroTape or another person, or submit false information; or
• Use the Site to send spam or other unsolicited commercial messages.

We may suspend access or refuse an inquiry if we believe these terms have been violated.

Privacy

Information collected through the Site is handled as described in our privacy policy, which is part of these terms. The Site is intended for business users and is not directed to children under 13.

Third-party links

The Site may link to websites we do not operate. Those links are provided for convenience. We do not control those sites and are not responsible for their content, terms, or privacy practices.

Disclaimer

The Site is provided “as is” and “as available.” To the fullest extent permitted by law, AeroTape disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, and warranties that the Site will be uninterrupted, secure, or error-free. Product performance and suitability are determined only under a separate written agreement and the specifications stated in that agreement.

Limitation of liability

To the fullest extent permitted by law, AeroTape will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities, arising out of your use of the Site or reliance on Site content, even if advised of the possibility. Our total liability arising out of the Site or these terms will not exceed one hundred U.S. dollars ($100). These limits do not apply to liability that cannot be limited under applicable law, and they do not limit obligations under a separate written agreement.

Indemnification

You agree to indemnify and hold harmless AeroTape and its officers, employees, and agents from claims, damages, and reasonable attorneys’ fees arising out of your use of the Site, information you submit, or your violation of these terms or of a third party’s rights, except to the extent caused by our gross negligence or willful misconduct.

Governing law

These terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Exclusive venue for disputes arising out of the Site or these terms lies in the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction there. If a provision of these terms is unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver.

Changes

We may update these terms by posting a revised version on this page and changing the effective date. Continued use of the Site after the effective date means you accept the revised terms.
